By accessing or using the Aikon Platform — whether via the website, iOS app, or Android app — you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you must not use the Platform.
To use the Service you must be at least 18 years old and have full authority to enter into this Agreement on behalf of your company without violating any other agreement you are party to.
By providing your telephone number, you give express written consent to receive communications from Aikon — including via automated dialling, SMS, email, or other means — for service and marketing purposes. Standard rates may apply. This consent is not a condition of using the Service.
You represent and warrant that neither you nor your organisation is a Restricted Entity under U.S. sanctions laws, and you agree to comply with all applicable export controls and sanctions regulations.
Aikon retains all right, title, and interest in the Service and its intellectual property, except for data you submit. The Service and all materials on it are protected by U.S. and international copyright and intellectual property laws.
Aikon trademarks — including AIKON LLC, www.aikon.app, and the Aikon app marks — may not be used without prior written consent. All other marks belong to their respective owners.
Subject to these Terms, Aikon grants you a limited, non-exclusive, non-transferable licence to: (i) access and use the Service; (ii) access reports and content generated through the Service; and (iii) manage your account and content. All rights not expressly granted are reserved by Aikon.
Unless expressly permitted, you must not copy, modify, reproduce, retransmit, upload, or distribute any Platform materials without Aikon's written consent. You also agree not to:

Aikon is a discovery and connection platform only. It does not facilitate, guarantee, or mediate any transaction between parties. All deals are conducted directly between buyers and sellers. Aikon accepts no responsibility for goods or deals that do not conform to any offer posted on the Platform.
The Platform may contain Third-Party Content that Aikon does not independently verify, prescreen, or monitor. Aikon does not endorse such content and is not responsible for its availability, accuracy, or completeness. Use of Third-Party Content is subject to its own terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIKON SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST REVENUES OR PROFITS — ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Aikon will defend you against third-party claims alleging that your permitted use of the Service infringes their intellectual property rights, subject to you promptly notifying Aikon, giving Aikon control of the defence, and providing reasonable assistance.
You agree to defend and indemnify Aikon against claims arising from your violation of these Terms, the data you submit, or your infringement of third-party rights.
This Agreement begins when you accept it and continues until terminated. You may terminate at any time by written notice. Aikon may terminate your access at any time, with or without cause, upon notice. Sections covering proprietary rights, disclaimers, indemnification, governing law, and miscellaneous provisions survive termination.
Upon termination, all materials stored in the Service will become inaccessible. Aikon has no obligation to retain or provide copies of your data following termination unless legally required.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute not resolved through arbitration shall be subject to the exclusive jurisdiction of courts in Sheridan County, Wyoming.
Any controversy or claim arising from these Terms shall be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. The parties waive the right to bring representative or class action claims. Any cause of action must be commenced within one (1) year after it accrues, or it is permanently barred.
Aikon may assign its rights and obligations under this Agreement without notice. You may not assign your rights without Aikon's prior written consent. If any provision of these Terms is found invalid, the remaining provisions continue in full force. Failure by Aikon to enforce any right does not constitute a waiver of that right.
